Directs and manages Compliance framework requirements for Dealer Financial Services - focused on collections, debt recovery, asset management and vendor management. Exercises judgment and influences business managers and peers to ensure adherence to regulatory requirements and appropriate risk management controls. Responsible for monitoring of business loan collection/recovery activities and developing Compliance testing with heightened emphasis on taking action based on testing results, identification of compliance gaps in business processes, ensuring resolution and escalation of compliance risk and providing independent Compliance assessment of area of responsibilities.
Position provides support for:
Recovery/Asset Management --
Supporting high Compliance risk areas for collection of debt post charge-off, affidavits, deficiency judgments, bankruptcy, repossession/replevin for charged-off loans and Compliance support for RMS (Recovery system). Significant high risk regulatory requirements for the following:
Reg F - FDCPA (Fair Debt Collection Practices Act)
Reg AA - UDAAP (Unfair, Deceptive or Abusive Acts or Practices)
TCPA (Telephone Consumer Protection Act)
OCC Advisory Letter 2004-02 Consumer Complaints
OCC Bulletin 2000-20 Uniformed Retail Credit Classification
Reg V - FCRA (Fair Credit Reporting Act)
SCRA (Servicemembers Civil Relief Act)
US Bankruptcy Code - Case Administration
US Bankruptcy Code - Creditors, The Debtor, And The Estate
Reg Z - TILA (Truth in Lending Act)
State Laws impact at state law level adhering specific requirements for collections, repossession, charge-off, affidavits, cease and desist, and all other areas of recovering debt
Ensure Compliance monitoring and testing program requirements are met, issues are escalated/remediated and assessments completed.
High visibility to collection/recovery efforts by OCC and CFPB
Vendor Management --
Responsible for vendor management compliance requirements and adherence to Vendor Management standards in supporting the business
High risk direct vendors (primarily repo agents) and coordination issues for vendors utilized by DFS but owned/managed by other LOB.
Includes vendor onsite visits and due diligence/monitoring and additional 6 monitoring activities
Requirement to work with other consumer LOB to ensure consistent application of regulatory requirements and increased visibility of other LOB compliance issues.
TO BE USED IN GLOBAL COMPLIANCE ONLY- Retail/Consumer - Implements and manages compliance programs for one or more business groups and related vendors. Exhibits Compliance influence and ensures accountability for Compliance elements of the Risk Framework, maintaining independent compliance oversight of business and vendor performance. Promotes the culture of Compliance and encourages the identification, escalation and timely mitigation of compliance risks. Exercises judgment and influences business managers and peers to ensure enforcement of compliance programs, balancing business strategy with appropriate controls. Proactively manages the relationships with regulatory agencies, external consultants and other internal risk management groups. May manage other employees.
Required Qualifications:
* Deep expertise in Auto Collections and the Laws Rules and Regulations impacting it.
* Strong communication skills to deal with internal and external constituencies
* Strong interpersonal and teamwork skills and ability to influence through collaboration
* Business acumen and a strong understanding of the consumer banking environment
* Experience mapping regulatory applicability, controls, assessing risk and establishing related testing programs
* Strong teamwork and project management skills and the ability to work in a "virtual" environment
* Ability to take data and turn into "information" connecting themes identified across various issues/areas
* Ability to understand details of business processes and compliance applicability
* Ability to multi-task and prioritize work in a deadline-intensive environment
* Proficient in Excel, PowerPoint, and Word
