Enterprise Holdings' Corporate Legal Group has an exciting opportunity for the position of Corporate Counsel - Marketing, reporting to the Vice President and Associate General Counsel, Sales and Marketing. Our new Corporate Counsel will have the opportunity to work on cutting edge marketing projects including our digital strategy refresh for all brands, connected car and electric vehicle initiatives, frictionless travel, our 5 million+ member loyalty club programs, and a host of marketing and promotional matters affecting our global business worldwide in 100 countries. We deliver our legal services through a highly matrixed, cross-departmental functional teams focused on particular specialities. The successful candidate will have the opportunity to collaborate with business stakeholders and colleagues in the Legal Group, in their areas of expertise, in Europe, the United Kingdom and the US, working on projects globally as part of these cross-departmental functional teams.

The successful candidate will join the Global Marketing legal team, which is primarily responsible for ensuring the competent and timely provision of day-to-day legal services in support of Enterprise's worldwide operations, including: reviewing and advising on marketing collateral and terms across all business lines and brands, such as daily rental, Car Sales, Commute, CarShare, Fleet Management; reviewing and drafting sweepstakes and other consumer promotions; reviewing celebrity endorsement agreements and sponsorship agreements with major sports teams (e.g., NHL, MLB); advising on marketing efforts and collateral for global franchisees; advising on loyalty club matters; and effectively coordinating with outside counsel resources.

With the convergence of mobility solutions, the advent of internet-connected vehicles and roll-out of alternative fuelled and electric vehicles, the next 5 years promises to re-write the landscape in traditional vehicle mobility. As the industry evolves, we'll be embracing new types of business that will require lawyers who are comfortable learning and advising on new areas and coming up with creative solutions to the issues of the day. We're looking for a lawyer that can think through problems, navigate the legal and regulatory environment and find ways to facilitate all this change.

The selected individual must be collaborative, creative, efficient, personable and results-oriented – with outstanding oral and written communication abilities and the ability to work seamlessly in a fast-paced, team environment.

This position is located at our Corporate Headquarters in Clayton, MO.

Responsibilities
  • Partner with internal stakeholders and other business partners on continual process improvements and guidelines
  • Assume lead role in structuring, drafting, reviewing, and negotiating business-critical contracts (such as celebrity endorsement agreements and sponsorship agreements with major sports teams) and ensuring they properly protect the company's interests and objectives
  • Clearly communicate or present (in writing or verbally) and advise decision makers on the risks and benefits of negotiating options and contractual provisions
  • Provide guidance to internal stakeholders on the application of U.S. marketing and consumer protection laws
  • Review and advise on marketing collateral and terms across all business lines and brands
  • Review and draft sweepstakes and other consumer promotions
  • Maintain and update loyalty club terms and provide guidance on loyalty club issues
  • Identify, manage and assist in the resolution of legal issues in a manner consistent with the company's business philosophy and strategy, and in compliance with legal and regulatory requirements
  • Provide timely and accurate interpretations of the various laws and regulations affecting the company's businesses to senior management and operating personnel; keep them apprised of the types of action that require legal consideration and provide internal guidance regarding potential legal risk
  • Manage and assist clients with resolving all legal issues pertaining to various corporate, transactional, and regulatory matters in a manner consistent with Enterprise Holdings' business philosophy and strategy, and in compliance with legal and regulatory requirements
  • Prepare best practices and present training to various personnel throughout the organization
  • Partner with assigned functional areas and operating units to help drive the Company's business model and execute its strategies
  • Provide ongoing strategic planning, guidance and consultation regarding potential and actual disputes

Qualifications

Minimum:
  • Juris doctorate from an accredited school
  • Must be authorized to work in the United States and not require work authorization sponsorship by our company for this position now or in the future
  • Five (5) or more years of relevant experience in a business law firm or in a corporate law department with a proven record of professional excellence and achievement
  • Significant legal experience with U.S. marketing and consumer protection laws
  • Experience reviewing and providing guidance on advertising and web copy as well as sweepstakes and promotions
  • Experience providing marketing-related legal advice on proposed business transactions, including reviewing and drafting contracts or contractual language with vendors and business partners
  • Trademark and intellectual property experience a plus
  • Ability to independently research and analyze issues
  • Admission to at least one state Bar in the United States is required, with the ability to qualify with the Missouri state bar
  • Intermediate level of proficiency with Microsoft Office Products (i.e. Excel, Word, PowerPoint, and Outlook)
