557582:  Senior Associate General Counsel, Privacy - Eden Prairie MN

As a member of the Optum Privacy team, the Privacy Counsel will focus heavily on the HIPAA Privacy and Security Rules, in addition to general consumer privacy rules and state breach notification laws.  The successful candidate will be a licensed attorney, must have a strong sense of consumer protection, be self-motivated, and possess critical-thinking and strong writing and organizational skills.  A Certified Information Privacy Professional (CIPP) designation is a plus.  Candidates must also have good judgment, the ability to analyze issues in a clear fashion, and present their conclusions in a clear and concise manner. The role spans a broad range of health care services including data analytics, software, technology services, direct patient care in clinical settings, de-identification practices, and government and financial services.  Experience with the broad range of privacy laws and regulations, including the HIPAA Privacy and Security Rules and FTC practices is highly preferred.  The position will report to the Optum Chief Privacy Officer.  In particular, this position will have the following accountabilities:

 


  • Advising on approaches to complex data privacy protection and needs within a matrixed environment;  

  • Advising Legal and business teams regarding proposed products and potential data use through “privacy by design”;

  • Leading and advising on privacy incident investigations and management;

  • Assisting the privacy office with inquiries from global, federal and state regulators;

  • Providing counsel on digital marketing and online behavioral tracking/online behavioral advertising;

  • Providing counsel on big data analytics, mobile apps, texting, web and devices, and social media;

  • Maintaining and developing positive and professional working relationships with all team members within the Legal, Compliance, and Privacy team and the business units;

  • Partnering with Information Technology teams for company-wide technology solutions implicating privacy; and

  • Partnering with Information Risk Management for security incident response and proactive security issues.

  • A JD degree and currently licensed as an attorney.

  • 8+ years of experience with increasing responsibility in Privacy and/or Legal role; specific experience with a Privacy program and incident management is preferred.

  • 5+ years of experience working with HIPAA, other national and state privacy laws & regulations.

  • Demonstrated breadth and depth of knowledge of compliance and privacy best practices and related legal/regulatory requirements and issues.

  • Adept at understanding complex concepts and situations presented by the business environment.

  • Ability to assess complex problems and recommend the appropriate compliance solutions.

  • Demonstrated ability to lead and influence in a large, matrixed organization.

  • Objective, collaborative approach. Ability to adapt in a dynamic and high-growth environment.

  • Exceptional written, verbal, analytical, organizational, problem solving and presentational skills.

 

Preferences:


  • Experience with international privacy is a plus.

  • Professional certification (CIPP/US or other) in Privacy is a plus.
