We are seeking an experienced paralegal to support our Brand Services and Privacy teams. The IP Litigation and Privacy Paralegal will work closely with Gap Inc. attorneys and paralegals and with outside law firms on US and international disputes and litigation related to trademark, copyright, patent, advertising, and privacy, as well as other IP-related matters, and will provide key support for various aspects of the company’s Privacy compliance program. With our collaborative approach, the Paralegal will have the opportunity to further develop deep knowledge and experience in these practice areas for one of the largest specialty apparel retailers in the world.

IP Claims/Litigation: Assist in-house counsel in all facets of litigation and IP claims. Identify and locate all relevant documents, data, and witnesses; collect, review, and organize information; assist in preparation of responses to claims and discovery requests as needed. Draft and respond to cease and desist letters. Negotiate the resolution of simple disputes. Manage litigation “hold” process. Act as point of contact for outside counsel regarding document and witness issues and manage the discovery process, including e-discovery. Coordinate depositions and deposition preparation. Work directly with internal business partners and outside counsel.

Privacy: Act as first level response for data privacy inquiries, reviewing, responding and escalating in accordance with established guidelines. Manage incident log and all corresponding data, developing metrics and reports as requested. Maintain the data privacy Incident Response Plan. Manage Safe Harbor certification process, including exhibits, documentation, project calendaring and deadlines. Maintain and update other tracking logs, including customer notices and privacy policies, global legislation, and vendor management. Create internal messaging and training materials. Review company policy and procedure documents with a data privacy and security lens.

Other IP-Related Work: Duties may also include trademark clearance, trademark prosecution and enforcement, reviewing and analyzing marketing and promotional materials for compliance with laws/regulations and company policies; assisting attorneys in review of product designs; and support on projects.

Minimum Education Level:





• College degree required

• Paralegal degree/certificate preferred

Experience:





• 3 years as a paralegal in IP litigation at a law firm or law department

• Trademark and copyright litigation experience preferred

• Data privacy and security experience a plus

• In-house experience a plus

• Title commensurate with experience
