The Financial Accountability section provides legal counsel and support to the Department's Divisions of Unclaimed Property, Accounting & Auditing, and Treasury in a wide range of subject matters spanning from business law, unclaimed property, governmental accounting, constitutional issues, and litigation and dispute resolution in a variety of administrative and civil proceedings. Attorneys in this section have the opportunity to draft legislation and rules, analyze legislation, research and anticipate risk on emerging legal issues, consult with governmental agencies on best legal practices, and develop strategies and arguments in preparation for presentation of cases in a collegial atmosphere. The ideal candidate is a team player with excellent research, problem-solving, analytical, and communication skills.
The Litigation & Special Projects section seeks a Final Orders Attorney. This section represents the CFO and the Department in civil, appellate, and administrative litigation and provides legal counsel to the Divisions of Risk Management and Consumer Services, Florida's Insurance Consumer Advocate, the Office of the Inspector General, and the Office of Human Resources. The ideal Final Orders attorney has exceptional research and writing skills and the ability to work independently on a variety of legal issues.
The Prosecution and Enforcement section represents DFS on behalf of the Divisions of Insurance Agent & Agency Services, State Fire Marshal, and Funeral, Cemetery, & Consumer Services. This section handles licensee discipline, licensure denial, and rule development, and attorneys have the opportunity to practice in administrative and appellate forums. Attorneys who work with the Division of Funeral, Cemetery, & Consumer Services will have the opportunity to gain valuable experience in litigating before a board.
The Criminal Law & False Claims attorneys are legal advisors to the Criminal Investigations Division (CID). This section advises sworn and non-sworn investigators state-wide on insurance fraud, public assistance fraud, workers' compensation fraud, theft of state resources, unclaimed property fraud, public corruption, and fire, arson, and explosives investigations. The section also represents the CFO's interest in False Claims Act cases served on the Department. Our attorneys work with investigators on a variety of matters, from developing complex, multi-jurisdictional organized fraud rings and scheme to defraud cases for presentation to prosecutors, to reviewing search warrants for sufficiency, advising on investigational procedures and agency policy, and preparing personnel for testimony. This section provides a substantial amount of training to CID employees.
The position offers a great work-life balance for the experienced attorney who is passionate about working in the fraud prevention arena and comfortable working with investigators, but ready to step away from the grind of a daily, full-time court caseload. This position requires occasional travel to provide training for division staff.
