IP Litigation Attorney

Position Overview
We are seeking an experienced IP Litigation Attorney to join our litigation team and manage high-stakes intellectual property matters across patents, trademarks, and related technologies. The role focuses on developing litigation strategies, drafting and arguing motions, coordinating discovery, and advising clients on enforcement and risk mitigation. The ideal candidate combines courtroom experience with a solid background in patent litigation and prosecution, and demonstrates strong analytical, writing, and client-facing skills.

Key Responsibilities

  • Lead and manage all phases of intellectual property litigation, including case assessment, strategy development, pleadings, discovery, motion practice, and trial preparation.
  • Draft, file, and argue dispositive and non-dispositive motions, including motions to dismiss, summary judgment motions, Daubert motions, and claim construction briefs.
  • Conduct and oversee discovery, including drafting and responding to interrogatories, requests for production, deposition preparation, and taking and defending depositions.
  • Coordinate with technical experts, in-house counsel, and patent prosecutors to develop infringement and invalidity contentions and expert reports.
  • Manage parallel patent prosecution matters where necessary to support litigation strategy and advise on claim amendments, estoppel issues, and licensing implications.
  • Advise clients on risk assessment, enforcement strategies, settlement negotiations, and alternative dispute resolution, ensuring alignment with business objectives.
  • Supervise and mentor junior attorneys, paralegals, and litigation support staff; oversee budget, staffing, and vendor management for cases.
  • Stay current on case law, statutory changes, and industry trends in patent litigation and IP enforcement to inform case strategy and client advice.

Qualifications

  • Juris Doctor (J.D.) from an accredited law school and admission to the state bar (specify jurisdiction as applicable).
  • 2+ years of litigation experience with a primary focus on intellectual property matters, including substantial patent litigation experience.
  • Proven experience drafting and arguing complex motions, including claim construction and summary judgment motions, and handling all aspects of trial preparation.
  • Technical aptitude or background sufficient to work effectively with patent claims and technical experts; advanced degree (e.g., M.S., Ph.D., engineering) preferred but not required.
  • Experience in patent prosecution and familiarity with patent office proceedings (USPTO), reexamination, IPRs, and related procedures preferred.
  • Strong legal writing, analytical, and oral advocacy skills; demonstrated success in client counseling and managing expectations.
  • Ability to lead case teams, mentor junior staff, and manage multiple matters and deadlines in a fast-paced environment.
  • Willingness to travel as required for trial, depositions, and client meetings.
