Purpose of the Role
Mandelbaum Barrett PC is seeking an experienced attorney to join its Employee Benefits and ERISA practice, working closely with the Trusts & Estates and Tax groups in our Roseland, NJ office. This role focuses on advising employers, plan sponsors, and fiduciaries on the design, compliance, and ongoing administration of retirement plans and employee benefit programs. The position also offers exposure to estate planning and tax matters.
The ideal candidate is capable of independently managing matters, serving as a primary client contact, and contributing to the continued growth of the practice. This role may be structured at the Senior Counsel or Partner level depending on experience and business development capabilities.
Responsibilities
- Advise clients on ERISA compliance, fiduciary duties, prohibited transactions, and applicable Internal Revenue Code provisions.
- Design, draft, amend, and terminate qualified retirement plans, including 401(k), profit sharing, defined benefit, cash balance, and ESOPs.
- Prepare and review Form 5500 filings and coordinate with actuaries, third-party administrators, and auditors.
- Represent clients in IRS, Department of Labor, and PBGC audits, including correction programs (VCP, DFVC, VFCP).
- Counsel clients on health and welfare plan compliance, including ACA, COBRA, and HIPAA requirements.
- Support M&A transactions on employee benefit matters, including due diligence and plan-related considerations.
- Advise on executive compensation arrangements, including Section 409A and deferred compensation plans.
- Assist with estate planning and trust and estate administration, including preparation of Forms 706, 709, and 1041.
- Provide support on tax-related matters and audits as needed.
- Serve as a primary point of contact for clients and provide strategic, practical legal guidance.
- Support and contribute to business development efforts, including maintaining and expanding client relationships.
- Mentor and supervise junior attorneys and support staff, reviewing work product as needed.
- Manage multiple matters, maintain accurate records, and meet billable expectations.
Qualifications
Required:
- Juris Doctor from an accredited law school.
- Admission to the New Jersey Bar, in good standing.
- 8+ years of legal experience, including significant experience focused on ERISA, employee benefits, or retirement plan matters.
- Experience independently managing matters and advising clients directly.
- Strong analytical, drafting, and communication skills.
- Detail-oriented with a client-focused approach.
Preferred:
- LL.M. in Taxation or Employee Benefits, or comparable practical experience.
- Admission to the New York Bar or willingness to obtain.
- Experience with IRS/DOL correction programs.
- Familiarity with executive compensation and Section 409A.
- Exposure to ERISA aspects of M&A transactions.
- A portable book of business or demonstrated client relationships is a plus.
Compensation & Benefits
- Base Salary: $170,000 - $260,000 annually, commensurate with experience and qualifications. Final salary reflects your skills, experience, and contributions.
