Labor & Employment Attorney

Position Overview
We are seeking a skilled Labor & Employment (L&E) Attorney (Senior Associate or Of Counsel) to join our litigation team. The Attorney will represent employers and management in complex employment disputes, including trial-level litigation, administrative proceedings, and pre-litigation counseling. The ideal candidate will have strong courtroom experience, a deep knowledge of labor and employment law, and the ability to manage caseloads independently while providing practical, business-focused legal advice.

Key Responsibilities

  • Manage a diverse litigation caseload from intake through disposition, including pleadings, discovery, motions, and trial preparation.
  • Represent clients in state and federal courts, as well as administrative agencies and alternative dispute resolution forums.
  • Conduct legal research and draft briefs, motions, settlement documents, and advice memoranda related to labor and employment matters.
  • Advise clients on compliance and risk mitigation involving Wage & Hour laws, leave policies, discrimination, retaliation, and other employment practices.
  • Provide counseling and training to HR and management on employment policies, performance management, discipline, and accommodations.
  • Handle trials and evidentiary hearings, including witness preparation, examining witnesses, and presenting legal arguments at trial.
  • Collaborate with internal and external stakeholders to develop case strategy, settlement negotiations, and cost-effective resolution plans.
  • Maintain up-to-date knowledge of statutory and regulatory developments affecting labor and employment law and communicate impacts to clients and colleagues.

Qualifications

  • Juris Doctor (J.D.) from an accredited law school and active bar membership in good standing.
  • Minimum 7 years of experience practicing labor and employment law with substantial litigation and trial experience; experience representing employers preferred.
  • Proven litigation skills, including drafting pleadings and motions, taking and defending depositions, and handling trials or evidentiary hearings.
  • Deep knowledge of Labor & Employment law principles and procedures, including employment discrimination, retaliation, wrongful termination, and wage and hour claims.
  • Experience advising on and litigating issues related to leave policies and statutes such as FMLA and CFRA.
  • Familiarity with ADA and reasonable accommodation obligations and FEHA (or comparable state disability/discrimination laws).
  • Working knowledge of wage and hour law, meal and rest period rules, and related compliance issues.
  • Strong written and oral advocacy skills, attention to detail, and the ability to manage competing priorities and deadlines.
  • Demonstrated ability to provide practical, business-minded legal advice and work collaboratively with HR and leadership.
  • Active litigation bar admission and ability to travel as needed for hearings and trials.
