Pre-Litigation Personal Injury Attorney

Position Overview
We are seeking a dedicated Pre-Litigation Personal Injury Attorney to manage and resolve injury claims before they proceed to court. The ideal candidate will make demands, negotiate with insurers and defense counsel, and recommend strategic next steps to maximize client recovery while minimizing the need for formal litigation.

Key Responsibilities

  • Manage a caseload of pre-litigation personal injury matters from intake through resolution, including automobile collisions, slip-and-fall, and other negligence claims.
  • Conduct thorough investigations, obtain and review medical records, police reports, and other evidence to develop case theories and damages assessments.
  • Prepare comprehensive demand letters, settlement packages, and supporting documentation tailored to each claim.
  • Negotiate with insurance adjusters, defense counsel, and third parties to reach timely and fair settlements on behalf of clients.
  • Counsel and communicate regularly with clients regarding case status, options, realistic expectations, and potential outcomes.
  • Work with experts, medical providers, and vendors to substantiate claims and document injuries and economic losses.
  • Identify cases requiring escalation to litigation and coordinate handoff to litigators, including preparing pleadings, disclosures, and transfer of files when necessary.
  • Maintain accurate case files, track deadlines, and ensure compliance with ethical obligations and firm policies.

Qualifications

  • Juris Doctor (JD) degree from an accredited law school and active Bar admission in California.
  • 1+ years of experience handling personal injury matters with a primary focus on pre-litigation claim management and resolution.
  • Demonstrated negotiation skills with a track record of securing favorable settlements from insurers and opposing counsel.
  • Strong written and oral communication skills; ability to draft persuasive demand letters and communicate complex legal concepts to clients.
  • Proficiency reviewing medical records, billing records, and other technical documents to evaluate injury causation and damages.
  • Excellent organization and case management abilities, including familiarity with case management software and document management systems.
