Attorney - Consumer Protection
Position Overview
We are seeking a skilled Attorney - Consumer Protection to represent consumers in lemon law, warranty, and unfair/deceptive business practice matters. The attorney will manage a caseload from intake through resolution, conduct litigation in state and federal courts, negotiate settlements, and, when necessary, take cases to trial. The role requires strong litigation experience, deep knowledge of lemon law, and a commitment to protecting consumer rights.
Key Responsibilities
- Manage a caseload of consumer protection matters, including lemon law, warranty, and unfair/deceptive practice claims.
- Conduct client intake, provide legal advice, and develop case strategies tailored to client objectives.
- Draft and file pleadings, motions, discovery requests, responses, and other court documents.
- Perform legal research and prepare briefs, memoranda, and persuasive motion practice.
- Coordinate and take depositions, prepare witnesses, and handle discovery disputes.
- Negotiate settlements with opposing counsel, manufacturers, and insurers to secure favorable outcomes.
- Prepare for and conduct bench and jury trials, including opening statements, examinations, and closing arguments.
- Collaborate with paralegals, investigators, and support staff to gather evidence and manage case files.
- Maintain accurate case records and ensure compliance with court rules, firm policies, and ethical obligations.
- Participate in business development, outreach, and client retention efforts to grow the practice.
Qualifications
- Juris Doctor (JD) from an accredited law school and active membership in good standing with the state bar.
- Minimum 2 years of litigation experience
- Trial experience is a plus
- Proven experience and substantive knowledge of Lemon Law and consumer protection statutes and regulations.
- Strong litigation skills, including drafting pleadings, motion practice, discovery, and trial advocacy.
- Excellent negotiation skills and a track record of resolving claims through settlement and trial.
- Exceptional legal research and writing abilities.
- Ability to manage a high-volume caseload, prioritize tasks, and meet deadlines.
- Client-focused communication skills, with the ability to explain complex legal issues clearly to non-lawyers.
- Proficiency with case management software, e-filing systems, and standard office technology.
- Preferred: experience with class actions, automotive defect cases, and bilingual ability.
