Lemon Law Litigation Attorney

SUMMARY:

Our client, a well-established law firm, is seeking a Litigation Associate Attorney to join its team. This is an excellent opportunity for an attorney with 1-3 years of civil litigation experience to take ownership of cases, develop litigation strategy, and handle matters from filing through resolution, with increasing independence and responsibility. The ideal candidate has experience with depositions, contested motions, settlement negotiations, and, importantly, drafting attorney fee motions in fee-shifting cases.

RESPONSIBILTIES:

- Independently manage a caseload of Lemon Law litigation matters from inception through resolution.

- Draft and file complaints, discovery requests and responses, motions, and other substantive pleadings.

- Handle discovery disputes, meet-and-confer communications, and motions to compel.

- Draft and argue motions, including oppositions to motions for summary judgment.

- Prepare and litigate attorney fee motions in fee-shifting cases, particularly under the Song-Beverly Consumer Warranty Act and the Magnuson-Moss Warranty Act.

- Take and defend depositions of plaintiffs, service technicians, and persons most knowledgeable (PMKs).

- Prepare clients and witnesses for depositions and testimony.

- Negotiate settlements, including vehicle buybacks and cash-and-keep resolutions.

- Evaluate damages, statutory penalties, and litigation exposure.

- Prepare motions, trial briefs, and other trial-related documents.

- Assist as second chair at trial, with opportunities to serve as lead counsel on appropriate matters.

QUALIFICATIONS:

- Active membership in the California State Bar.

- 1-3 years of civil litigation experience.

- Experience conducting depositions and handling contested motions.

- Demonstrated experience drafting attorney fee motions or fee petitions is strongly preferred.

- Experience with Lemon Law, consumer warranty litigation, the Song-Beverly Act, or the Magnuson-Moss Warranty Act is preferred.

- Strong legal writing, analytical, negotiation, and client communication skills.

- Ability to manage deadlines, develop case strategy, and handle litigation matters with minimal supervision.
